Terms of Service

1. Agreement

By accessing or using FranchiseKit ("the Service"), operated by FranchiseKit ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

FranchiseKit is a multi-tenant franchise management platform that provides tools for applicant onboarding, workflow automation, training, communications, helpdesk, location management, and related franchise operations. The Service is provided as a cloud-based software-as-a-service (SaaS) application accessible at getfranchisekit.com.

3. Accounts & Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

Each organization operates within a tenant workspace. The account owner is responsible for managing user access, roles, and permissions within their tenant.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to the Service or other users' data.
• Interfere with or disrupt the Service or its infrastructure.
• Upload malicious code, viruses, or harmful content.
• Resell, sublicense, or redistribute the Service without our written consent.
• Scrape, crawl, or automated-access the Service beyond normal use.

5. Your Data

You retain full ownership of all data you upload to or create within the Service ("Your Data"). We do not claim any ownership rights over Your Data.

You grant us a limited license to host, store, and process Your Data solely for the purpose of providing the Service. We will not access Your Data except as necessary to operate the Service, provide support at your request, or comply with legal obligations.

We do not sell, share, or use Your Data for advertising or any purpose beyond operating the Service. See our Privacy Policy for full details.

6. Pricing & Billing

The Service is billed on a per-location, per-month basis as described on our Pricing page. Franchise applications are free and do not count toward billing.

We offer a 30-day free trial with full access to all features. After the trial period, continued use requires a paid subscription. We may change pricing with 30 days' notice.

Payments are processed by Stripe. You agree to provide accurate billing information and authorize recurring charges for your subscription.

7. Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation:

• Your access continues until the end of the current billing period.
• No further charges will be made after cancellation takes effect.
• You may export Your Data before the end of your billing period.
• After 30 days, your tenant data will be scheduled for deletion.

There are no cancellation fees or long-term contracts.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.

9. Intellectual Property

The Service, including its design, code, features, and branding, is owned by FranchiseKit and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

10. Limitation of Liability

To the maximum extent permitted by law, FranchiseKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Termination

We reserve the right to suspend or terminate your access to the Service if you violate these Terms, engage in abusive behavior, or fail to pay applicable fees. We will provide reasonable notice before termination except in cases of severe violations.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service will be resolved through good-faith negotiation before pursuing formal proceedings.
